You have to be aggressive and presistent to get a new job where you get better pay that is above the prevailing wage.

Yes, that is right, I said “plight of EB2-India”.
I am a passive observer of these forums. But some of the ridiculous notions floating around here have motivated me to vent. First and foremost, the law as written is highly favorable to people in EB3 categories, even from India. Here is how...
Take my example (and there are thousands like myself)....came to the US 8 years ago, spent 5 years working day and night to earn a PhD on a low (barely sustainable) stipend, got FIRST job saw decent money for the first time 6 years after I came.
Now, compare this to a person working an EB3-job for the last 8 years. Not only does this person do a real job that hopefully provides a respectable income but this person also has the option of moving to EB2 after 5 years of experience. So, at the end of the day in 2008; this person comes out ahead of me in terms of money, in terms of priority date (if ported) and most likely in terms of GC.
There are complaints all over the forum which have the stink of pretentiousness such as “oh..i am a poor EB3 waiting for n number of years” etc etc. What you guys seem to forget is that YOU are NOT an EB3, it is your JOB that is EB3. You have all the opportunities that were/are available to a person who sweated it out in the university system here to gain more qualifications and get an EB2 job. You CHOSE not to. The general discussion seems to center around cribbing about the US immigration system (Immigration by the way is a privilege defined by laws, not a birthright) and then blaming the EB2 crowd when they finally see the system implement the law as intended in the first place (horizontal spillover rules).
All these posts that refer to “my career is over because my gc is delayed” are nothing but a pathetic excuse. Law of supply and demand....if you have a skillset that is valuable, you will be fine with or without GC anywhere in the world. It takes a bunch of documents to remain here legally, all you need is a passport to go back if the system here seems so bad.

Just curious. Why do you claim ROW is receiving preferential treatment over India when all the countries get the same upper limit of the visas. Now if the Indians ask for more visas just because there are more Indians asking for green cards, wouldn't that be preferential treatment?.
I wouldn�t say ROW is receiving preferential treatment, but they are in an advantageous position due to their representation. I don�t think there will ever be a consensus on the quota issue, both ROW and India/China applicants come up with their own arguments supporting their stand on it.
Personally I think recapturing unused visas will decrease the wait time for India/China applicants without affecting ROW applicants. There won�t be any need to remove quota limits.
And I agree with rajeshalex that this thread needs to be closed. the counter arguments are getting more confusing...

When you join a state chapter or a group in your area, it is not necessary to conduct face-to-face meetings everyday/every week, although in person meetings wouldn't hurt. The idea is to create a channel to dissipate information through channels other than WWW. Believe it or not, there are lot many folks from anti-groups who lurk around just to keep an eye on us. Participating or becoming part of the group near to you and encourage others to do the same will also help to build/strength a group of like minded folks in the area who could then team-up to meet with local lawmakers from your area/state. We are a grass roots organization and we need to have a stronger grassroots in order to continue to be more effective. As I said earlier, this channel also is very useful to dissipate information which cannot be shared on world wide web.
Now a days when everybody has presidential election on their mind, immigration issue is not on the list of things to do for most lawmakers. As such, it takes time for the updates and the there are updates that cannot be disclosed on www. We continue to work on our issues in manner we have always worked in the past. And in the absence of Congress not taking up our immigration issues, it some how becomes our fault even though it is ok if some folks would show up from time to time and suggest that they have reasons not to join a google or a yahoo group. And all of a sudden the problem is with organization and the manner in which we work and then there is an urgent to create a �process�. Although you seem to be suggesting that you want all the ducks in the row and world peace issues sorted out before you will start accepting updates in exactly the manner in which you like to receive them. Is that correct? How about the idea of getting actively involved in your area and create an active chapter, which was your idea to begin with, and one I would agree is an excellent idea.
It is of'course a valid question - �what is going on�. Also it is a very general statement and one which can have a very long answer and one which can be answered in few words. If you become part of a group in your area, you will know what is going on. I am not waiting to see some success, before I join the band wagon. When you started IV a few years back, I am not sure you envisioned this many members today. Inspite of having over 25000 members, the admin fix compaign only seem to have received about 10% letters. So, What are the other members doing? Why are they not participating? what is holding them back? That is a question for everyone of us. That is something, I thought every member should reflect upon. We have around 25000 members here in IV. But, we know for a fact that there are atleast a million people waiting in line. How do we reach them and how to get them to actively participate in IV action items?

I had been to Chennai recently two weeks back and absolutely had no problem in getting visa stamping renewal after 3 years of expiry.
I received my passport from VFS office directly the next day but not the same day. I do not know the delay was common now a days. However one of my friends receieved the passport the same day evening from VFS after attending interview at Mumabi consulate. Jut FYI for all.

All I have to say is .. do NOT bring parents or relatives to the US , period. Healthcare is pathetic and will rob you off tons of your hard-earned, precious savings. If you want to meet your parents/relatives, go to the home country but do not bring them here. I have heard far too many horror stories related to medical emergencies and the last thing I want is to put my parents in that kind of situation. In fact when my mother heard about the medical expenses here, she is terrifed to come here and wants me to come visit Pakistan instead, which I will gladly do.

What happens to the wife (dependent's) EAD, when the main person:
- loses his H1 status but has an EAD and is working on it
- loses his EAD status because of I-140 withdrawal
- is on EAD and is unemployed for some period of time
In each of these cases, if the wife is working on EAD, should the wife stop working on her EAD ?

Its not my fault that someone from Europe doesnt want to come here and not so many from Africa or south america qualify for the EB visas.
As one of the 'not so many from south america that qualify for the EB visa', this comment just further draws me away from this forum.
Do you really think the 10k or so wasted visas will honestly make a dent in the demand? I highly doubt that the wasted visas are caused by ROW not applying or 'qualifying' because last time I checked there was still retrogression.

You are right.. I got a call this Wednesday from the Presidents office of initiating an inquiry on my case and again a repeated call from them on Friday that FBI Name Check has been cleared. I forgot to mention this detail in my excitement.

My lawyer put in a SR on Sept 1. On Sept 11 i recd. the email saying that i was approved. My situation was similar to yours. Same company for 8 years, no RFE - infact no updates on my online status since Sept 2007 when it was first updated to reflect the fact that the application was recd at NSC. So i am assuming that SR triggered review of the application but with USCIS who knows.
Hopefully you will get your approval soon if my case is any indicator (admitted the sample size = 1)

Our case is a tricky one because we do not have enough leverage to push the government to resolve quickly the mess it created with the backlog and the retrogression.
The only way to fight it is to expose our case broadly via the US media. I was promoting this idea since I joined IV. In the beginning I was critisized for that since the core group thought that lobbying was an universal tool but later they changed their mind. So, I deeply believe that broad media coverage can only help solving the legal immigration mess.

So, they can't promise you some rate the moment you hit the submit button. They will pool all the transactions like yours and then do a big contract together. ICICI provides lot of other services which SBI will not in terms of convenience. And ICICI deals big time in forex transactions. In this market the guy with biggest transactions will have lowest cost and depending on competition will have incentive to pass it on to you as an end user. They might time it within a particular time frame but that is something unavoidable.

Couple of my friends, who have 3 year degrees from India and also have 2 year Masters degree from India, have not been able to apply for EB2. Their lawyers suggested that 3 year degree are a hindernace to get EB2. They both have not tried applying for EB2 and both have active EB3 applications.

Ok. I agree with everything you say but you still haven't explained why EB-2 China hasn't moved. They never were Unavailable, which means they haven't used their quota but are still retrogressed. Why absolutely no relief for them? Not even a month forward movement?
To be honest, I have no way to know why absolutely no change for China. There have been times earlier where India and China had similar cut out dates, then they changed dramatically, then India became unavailable, and now they are same again. With so much happening, I would say its very difficuilt to have a logical reason with no real data.
All I can come up is that perhaps China might had a little higher demand than India in the last few months, or just that in case of spill overs, most visas might be consumed by countries most retrogressed, or perhaps DHS believes that the number of visas spill over would be only enough to cover EB2 Inida + EB2 china up to a certain date and China was already at that date, so if the demand is less than expected, then we will see movement in both India and China.
Wish best for all Employment based filers. Hopefully some law change comes and justice is done to every one.
I would hate to see different immigrant groups worrying about which group is getting ahead.
