I know many people are going to blast me and curse for after reading my post but I think NEw H1b , greencard applicaitons , or any other route that leads to GC should be banned for countries that are severly retrogressed in EB category ...same for the FB based new applications....Doesn;t make sense..one side US business needs H1s so they fight to get it in thier favor but on other side the life of these H1b / L1/L2 guys becomes miserable the moment they get in the GC line.....

Friends, any thoughts on the below questions..
Raj, Thanks for the reply. I am still looking out for the bride which is the reason it may take about a year or so.. So no chance of civil ceremony in a months time.
I have few more questions..
1) What does it really mean by withdrawing the I-485 ? Does it mean you withdraw only the 485 application and can reapply (just 485) it later when you are ready (when its current) ? Or does it mean the full GC process is cancelled, which means you have to start with your labor again at later point of time?
2) What are the real benefits of applying now for I-485 in my scenario? If I get married after the 485 is filed, it sounds like I am forced to anyway maintain my H1B till I get my spouse on H4. Also to apply for my spouses 485, my PD must be current at the time of filing. If not, then again I am forced to maintain my H1B till the dates become current.
Just to summarize, it sounds like I have to anyway maintain my H1B till I apply for my spouses 485.
So far, does it sound correct ? If not, please correct me..
If the above is correct, why not I apply for 485 after I get married ? Is that a bad idea ? I know I could save about 6 months to an year (may be more in some cases) if I apply before the marriage, but then I am taking the risk of getting approved 485 before my marriage.
Any thoughts?

usually..the banks give the rate the day the money was deposited in the indian bank..not the day you initieted the transfer..
make sure u got tht rate..and how much do they charge for transfer..
i am sure they have a customer service where you can ask the break up of charges applied to you..without CS, they wont be in this business..tlk to CS,
they wont be happy to lose a customer.

I recently went to South Korea and entered the US on the AP since I didn't feel that I had enough time to wait for my H-1B stamped in my passport at the US emabassy in Seoul. Before leaving the US, I consulted with my attorney on this issue and she assured me that my H-1B is valid as long as I file the extension and maintain terms of the H-1B visa.
Per your attorney, you need to file an extension. How soon does one have to file? Do you have to file one even if the current one is still valid for more than 6-month? Have you done so since your travel? Thanks in advance.

Did anybody used IMG Global Medical Insurance for parents? How is their service about availability of providers and claim processing.
They are suggesting that people above 60 years old multiple deductible plans. For $2500 deductible and $100,000 max premium is $1300.00 for 6 months.
I am planning to take.

You can trade commodities like stocks by taking a directional bet on long term price movement. But this is what you need to consider. Stocks always trade in Spot. If you buy MSFT you own shares of Microsoft today. Although single stock futures (SSF) are available now we will not look at derivatives right now.
Commodities are traded as futures. You can buy Soy futures today for December delivery or lean hogs for dec 2010 delivery.
Under conditions of No-Arbitrage the price of the future will be the price of the spot plus storage and delivery costs. If for example 3 month LSC (Light Sweet crude) is trading on NYMEX at $60; the cost of storage and delivery is say $20 for 3 months. Then 6 month LSC should be trading at $80. But if you look at the contract it might be trading at $55.
The reason being fundamentals. The peak driving season or the hurricane season is over and heating oil season is not yet on us or by looking at weather derivatives traders are factoring in milder winter. The leader of Iran has declared he will step down from office and retire to Hawaii, the rebels in Nigeria have turned themselves in and joined a church missionary..stuff like that.
So you might believe these fundamental assumptions or you might do your own research and say that the traders are wrong and they are discounting critical factors and the price should be more. So you can go long the future and hope for an increase in price and sell the future before delivery for a profit. This is the expensive route but you will never be wiped out for sure. Price of crude may drop but will never go to zero.
Or you trade options on the futures, for example:
Borrow money (leverage) buy the call; short delta units of the future contract and invest the proceeds at the risk free rate.
If you are correct the call will end up in the money, the shorted futures will loose value but since it is delta units it is only a portion of the position and the invested money will earn you the risk free rate. So you make some money on the call and loose some on the hedge and net you will profit. (Hopefully to cover the transaction costs and taxes)
If you are wrong (price falls) your call will expire worth less so you are wiped out there, your short will increase in value and you will still earn the risk free rate. So although net you will loose money it will not be as much as a naked call because of delta hedging.
This is explained in very very simple terms. Each transaction step will indicate modeling prices to know if the future is priced correctly, if the option is priced correctly and if the leverage you are getting is correct. Plus modeling future price movements and expected rate of returns and the most primary thing in any transaction the Alpha. Source of alpha should be very clearly defined. Let me go a bit deep and include some simple math:
E[R] = Alpha + betaR + epsalon
Where E[R] is the expected return-(see statists for more on expectation functions.)
alphais the excess return
betaR is market return or what the price of the commodity does in the duration chosen. (Market betais 1)
epsalonis error term or un explained return.
(Sorry the greek symbols did not display so I wrote words)
This is a kindergarten model of modeling your alpha. As there are many variables you will use a multi variant model to figure out return. Plus as I said in my previous post you have to model jumps. Jumps are spikes of very short duration which will only be seen in a log normal price distribution. A Gaussian distribution might not be changed much because of a spike of small duration. For example if you are trading electricity and the temperature in NJ hits 110 degrees, there is going to be a spike on that day for electricity prices but this will fall as soon as temperature falls.
And the core issue of all is you need to have access to products as indicated by puddonhead plus money and leverage capacity and risk bearing capacity. As you see this is not for the faint of heart or for some one to do part time. If you are really sophisticated and can do this with good resources, fine or else my advice is stick to stocks or stock derivatives. Hedge funds have teams of quants and super computers sitting and doing this every day. They will vacuum out even the slightest of alpha out there; they will simply take your money if you enter into a wrong trade. If someone is a quant and does this for a living then if his contract allows it or if his licensing allows it legally he can do it on the side but apart from it definitely not something the retail investor should indulge in. Just invest in some ETF like GLD or USO or some commodity mutual funds at the max.
Best of luck!!
Again a great post. Just want to comment that be careful with ETF's too. Most of the ETF's are not physical commodity holders. They play in futures and OTC swap markets.
I have looked hard to find ETF's or MF's fwhich are pure commodity holders e.g gold, silver etc.I still have not found good ones. The closest I could get was some portfolio of mix of real assets and futures. Most of the ETFs are again leveraged and kind of trap for average investors.
There are a few hedge funds or big funds which might offer pure plays but those tend to have huge entry investment requirement basically making them inaccessible to individual small investors.

You do NOT have to go anywhere - what you are saying is "SBI Rapid Remittance" by SBI where the money will reach your Foreign account the very next day ( But you might have to wire the money as well to BOA-NY or SBI-NY ?)
www.onlinesbi.com/rr - This is SBI's response to rapid exchange.
What i'm talking is "SBI Direct Remit" & takes 3-4 business days but just click of computer mouse once you are set up. I actually set it up Monday morning EST and Friday Morning EST i see my money at Foreign account. No need to open a account at SBI-NY or anywhere but its good to have the target account at SBI ( it can be your mom/dad's SBI a/c or yours , doesn't matter really )
www.onlinesbi.com/glsus
P.S: By the way - i also had the idea that SBI is "sarkari bank" - slow , unprofessional etc... etc.. But the band of peoples who handles this division are really young and bright - my experience for last 6 months is just terrific. Customer Serivice also replies via email the next morning ...
Good info, thanks. I recently registered with the SBI NY (http://www.statebank.com/) branch office, to use their remittance service to send money home (to an SBI India account), but you have to fill out and mail a remittance form to them each time you want to do this.

Hi letstalklc
Thanks for your reply.
"SBI will update only once in the morning" Just wanted know the morning of India or USA ?
Ok, I just did myself and man you are RIGHT.
Today's exchange rate is [USD 4001 10000 48.07]
and I got ($$$ X 48.07) - 25.
Many thanks for the knowledge.
I am not sure if ICICI also does the same, because I too have stooped using their service. And you know what, I called when once when I had a very bad exchange rate given. I said that I will quit using your service and surprise surprise they didn't care. And ,now, So Do I.

I received a call from my lawyer last week saying he got a call from USCIS asking the lawyer whether my wife got the TB Skin test done or not, as she did not get it originally as we were expecting our child at the moment.
I sent the lawyer the scanned copy of the TB skin test results and posted him the sealed envelope separately yesterday, which he was planning on Faxing over to USCIS. Today I saw a soft LUD on my wife's I-485.
Don't know what this means? Its hard to belive that my Lawyer is so proactive to send the fax right away. And I can't believe that someone at USCIS actually updated my wifes case after lawyers response...
So don't know whats going on there... Friends whats meant by pre-adjudication?

When you call the law makers and tell them you support XYZ bill.. my question is what do you get out of it!
When the lawmaker realizes that he is getting 10000 calls from LEGAL aliens,
>who are not from his constituency,
>who cant vote and
>who cant contribute to his election campaign
what is the motivation for the law maker to support the bill
So to avoid sounding stupid and foolish and desperate when you call a more logical approach would be to :
a) Generate a public petition form on IV website and have all the members login and sign the forms digitally
b) Then have IV reps.. fax them and send them to lobby groups .
c) Lawmakers will listen to one talking headand not worry abt 1000 calls that borders on ..saar support the bill saar..
How many of you have actually talked to the lawmakers? Its always the assistant!
But instead .. someone says we have a signed petition of 25000 members effected by immigration mess . And its a hi tech workers lobby group ..every lawmaker will talk to you and not the assistant!
Conclusion: calling the lawmakers haphazardly is actually hurting IV cause..to a certain extent!
if you don't call and speakup, how will the lawmakers know?
your suggestion sounds great. I am sure we can accomodate that too.
Its better to have attack on many fronts than stick with one.
We need to rise and speakup, thats all matters in the end.

I agree too with the original post by pointlesswait !! ..digital signature is good ..or if there is a site which allows people to show their support (I guess there are sites like these) .. also, in the document we should include these points (small and precise document) ..
- why legals are suffering
- advantages that legal immigration brings to US
- the effect of few senior professionals leaving the country etc .
..for e.g. ..if a senior programmer or lead gets frustrated and goes back then all this happens ..he / she takes the job away with him ..and in turn trains 10 other people (so more jobs go away). also along with a skilled person - all the investment and taxes are lost ..(for eg ..house + prop tax + living expenses etc etc) .. and the fact that US is turning older (i.e average age ..) etc etc
and a related point ..each IV member should try to contact 5 other immigrants and tell them about IV ..and they in turn should atleast show some sort of support
