    I am married to a US citizen and I got my I-485 interview on 1/4/08 and IO said we have no problem about the interview. He said if I had my NC cleared I would get the GC in 2 weeks.
    I submitted I-485 on 5/11/07 so I assume that my name was forwarded to FBI sometime around May/07, 8 months ago. I made a mistake on my affidavit and I had to resubmit it on Aug/07 (I-485 was fine)

    I have a few questions;

    1- Since I resubmitted some papers on Aug (not I-485), would my name be forwarded to FBI on Aug or on May 11 (Priority date of I-485 is 5/11/07)?

    2- Most of the cases here seem to be about EB GC. Is there anyone who has the same problems with me? Is the procedure different for GC through marriage?

    3- When my wife called USCIS, IO told that they cannot do anything before 60 days after the interview. is that true?

    I was out of status when I got married so I cannot leave without GC. we want to move to my country but now we are stuck. it is frustrating.

    Please someone help...

    2. Unforunately it's the same process. I know folks stuck for 3-4 years waiting for NC in marriage-based cases. But do not be scared, it looks like most of the delays are attributed to older cases. It seems NC procedures has been improved lately.

    3. It's the USCIS policy not to respond to status inquiries if there was any action on your application within last 60 days. It does not mean the USCIS cannot work on your application.

    It was a good decision not to leave the country. How many days were you out of status?

    Actually, not all he said was wrong.

    I totally support reform in the H1 process with a target to reduce fraud. That will ultimately benefit people like us who will come here on H1B in future.

    Please don't fire me for taking his side, I'm not. I'm in favour of market deciding what it needs, but I'm 100% against fraud, and all of know these so called consulting companies ARE indulging in fraud..

    These sentiments are understandable.....but......

    "I know the American people want a sensible system in place that gives their children a chance at these highly skilled jobs".

    Here at best he is massively overblowing/ magnifying the abuse.
    So the American children "don't have a chance" (?!!) now and these "reforms" will give them a chance?

    I know groups that represent workers and visa holders want reforms
    Interesting to note that he is even aware that visa holders want reforms. But we shouldn't be surprised if he and Dick intoduce a new bill offering stringent H1B restrictions with very little or no scope for EB backlog elimination.

    Folks,

    As a core member I thank you all for your support. IV needs your help with two things. First and foremost, our numbers need to grow. Right now we have about 6,000 members, but we all know there are far more people than that stuck in limbo due to backlogs in the legal immigration process.

    Why do we need more numbers? Because when we go to talk to people on The Hill (and I live in DC and work here and I go as well), we have to convince them that we are a sizeable chunk of people in terms of our numerical strength that will vote when we become citizens. This is why we need to get working on this immediately. Talk to your family, friends and colleagues who are stuck in legal immigration backlogs, and get them to join IV. Each existing member should get at least one new member to join up. The more, the better.

    Secondly, we need more members to become paying members. This is crucial, as all our work requires $$$. Saying "I'll pay when the work is done" does not help us. The work requires a steady cash flow, and while pledges are deeply appreciated, we can't operate merely on pledges. Many core members work very hard on raising money and on publicity.

    So, I earnestly request your help in recruiting new members as well as strengthening our funding. Thank you!

    I second what rheoretro has written............

    As someone who has started working with the core group, I now fully understand the amount of work that goes into IV activities. At this time, IMHO, the best that all the other members can do is to contribute money to IV and spread the word about IV. Just getting your closest friends to sign up and CONTRIBUTE (if they are immigrants awaiting their Greencards), is the best thing all IV members can do for IV.

    Don't bet on this too much. Not being pessimistic, but in a democracy it is not just what is done but who does it and how it is done. Why should Republicans in the outgoing Congress vote again on a bill when their majority status is obsolete now? Do you think democrats will allow this outgoing congress to take the credit? they are politicians too, anything crappy in that bill is going to be the new Congress's (read Democrat's) burden. Already, a bombshell is waiting in the form of a hastily passed by the house_hastily signed by teh President bill: there is a fine print that removes oversight of how money is spent in Iraq (at least some of it). So, there may even be review of hastily passed, pre-election bills. anything more like this is going to give this congress very very bad name and the next congress a really bad headache.

    CIR is a heavyweight bill. Heavyweight bills passed hastily leads to heavy indigestion. Look at the parliamentary history in US and India. We need lite weight riders and hitchhikers. Pushing on CIR is betting on a horse that is soon to be retired, with masked broken limbs..

    Next move for EB should be THE decisive, concise, striking at the heart and quick. CIR is not the best bet for that.
    Somthing early spring would be the ideal thing to expect before the political capital is lost by the new congress.


    Was just watching Late Edition on CNN..with Arlen Specter and Chuck Schumer.. Specter did mention that he expects the CIR to be passed in the next few weeks in the lame duck session by the house.. infact he mentioned that the conservative outgoing speaker Hastert in favour of this at this time..so house might pass this now..with the senate already passed this..

    Lets see who this goes ..

    I think the best way to approach this thing is to increase visibility of the "American competitiveness challenged" idea. Which is basically - globalization has made it easier for foreign students and high skilled professionals to go to other places, besides the US. This is a long term problem for American competitiveness and immigration laws must be adjusted to solve this� (you see where I am going with this).

    Recently a group of influential CEOs pressed lawmakers and the Bush administration on the idea and subsequently several studies/ reports were released (I have attached one such report). Let�s build our case and momentum on this for next year (let�s face it: immigration reforms are dead for the year). I think the IV leadership has a huge opportunity in guiding/ co-ordinating such an effort.

    Yes, I guess the slowdown will happen when it hits the 2005 mark when PERM was introducted and a lot of EB3 were converted into EB2

    Yep, that's "bull period". But assuming AOS bulletin mirrors CP bulletin, it looks like USCIS has decided to play with EB2-India. According to its own process, if USCIS might be working then this bulletin was not expected. 2 things I can think of. (1)EB3-ROW (From which numbers flow to EB2 -ROW then Eb2-countries) is confirmed empty and thus EB2-ROW is empty too (2) Somehow abrupt decision. If it is no:1 then it is really good news. But if it 2 then it will be bad for EB3-India as EB3-India is the MOST suffered lot during 2002-8. and Per country limit will make it more suffered with this illegitimate forward movement of EB2-India. Let's wait for AOS bulletin.

    good thread. I do little bit of trading myself from a personal brokerage account and made some pocket change (few hundreds by trading commodity ETFs) recently. in layman terms, can u explain wht do u mean by ' US natural gas market is in contango' .

    First of all note that the original post was alomst year and a half old so dont go by the ideas there now :D

    In commodity markets you trade futures and spot. Spot means immidate delivery of the under lying commodity. In futures you pay today for delivery at a future date. So typically the price of the future will be the price of spot + the storage charge (simple calculation to give you an idea considering no premiums). As the day of delivery approaches the price will pull to spot price. For example if west texas intermediate (WTI) crude is $92 spot price the 3 month future will be $100. (92+8 for storage). Considering that the spot price does not change at all, in three months time the price of the oil you will now be purchasing will be $92, but you paid $100 for it. This is backwardation. This is usually how markets are most of the time.

    Now if in 3 months the price of WTI is trading at $110, you will own oil you paid $100 for and now can turn around and sell for $110. This is contango.

    When you buy a commodity ETF, they dont take actual delivery of the product, they roll their contarcts. So they will hold a 3 month contarct and when the third month approaches they sell the contarct and get another 3 month contaract. If market is in backwardation then they will always be buying high and selling low. If market is in contango they will make money but as soon as it switches back to backwardation they will ride down the slide and loose all the money they made. So I dont think ETF's are agood way of making money in commodities passively. You can actively manage the ETF portfolio and make money using options and hedges and leveraged ETF's. But buy and hold, I suggest go and invest with a CTA who will be trading rule based to negate the effects of contango and backwardation.

    Thanks, you are right. It's like the water bucket analogy. Put your hand inside the bucket, and then take it out, and you won't see much difference in the water level. That's how expendable we are to our employers.

    A lot of people are indespensible based on employer needs and competition and skills. So you just have to find the right employer and concentrate on your skills.

    Companies like MSFT and Google believe in retaining employees at any cost and taking care of employees in best possible ways. But getting into them will be competitive.

    So it all depends on a lot of factors, company finances, employer attitude, bad luck, bad time, business going down, bad managers, problems in departments, co workers issuees, consulting company blues, immigration issues etc.. ................

    The chances that someone goes through this situation is 100% and remember no one is "despensable" or "indespensable", it is all about how resistant you are to changes

    I have read in several forum that one cannot form own company and sponsor H1 through that. The logic is sponsoring H1 is work and you cannot work without H1.
    I think it is acceptable logic. Otherwise many would have sponsored H1 for self.

    Check with some attorney.

    I started my company when on H1 but I did not sponsor myself or anyone. I also did not withdraw earnings from the company since it was not my main income. I only started withdrawing earnings from the company after I got my GC and I can claim on taxes. But it is a good idea to ask an attorney.

    Can I add my spouse before or After marriage?I am planning to get married in 4 to 5 months.My attorney told me that he will be ready to file I-485 in July and my current H1-B is valid till Dec 2007,so if I go back to country for marriage and coming back on AP,so I think so I will be ok,but should my wife able to get H-4 visa stamp on her passport and once she came back in USA on H-4 should I will be able to add her right away in I-485 when PD dates will be current or should I have to wait 60 days then apply her for I-485.

    HR 5882 and HR5921 not only help alleviate ( I am not saying eliminate) backlogs in EB, but also help reduce (Not eliminate) FB backlogs by doing a recapture and carrying over the wasted visa numbers. Do I need to say more on to whom FB matters the most? Don't you think the members we called have an interest in supporting these bills? If you think that only lobbying using those high tech firms helps us get out of this, you must be dreaming.

    that was the idea behind it, but when a feature is being misused and exploited that needs to be plugged. If microsoft needed a genius they can bring that person in on EB1 or H1B or B1 visa. there are many other avenues.
    How do u feel that a person who arrives in US yesterday, buys a labor, gets his GC within a year while thousands of us are waiting patiently.
    It is an unfair practice and should have been stopped long time back.
    It's never too late though.
    Selling labors became the business model of manyof these companies.
    Are they doing anything illegal? NO.
    Are they doing something ethical? NO
    So, the law has to change to give everyone a fair chance.

When he asked his supervisor why so many foreign nationals were being hired, the head of human resources said: If the company has an American and a person from India, both with the same skill set, the company will hire the person from India because they can pay them less. These are firsthand stories from U.S. workers.

    I ask those begging for an increase in foreign workers to explain these cases to me. Why are Americans struggling to get jobs as software developers, data processors, and program analysts?

    Background Checks




    WASHINGTON � The Senate has approved an amendment by Sen. Carl
    Levin, D-Mich., to improve oversight of the FBI National Name Check
    Program, which faces a substantial backlog. The program is used to
    run background checks on people applying for immigration benefits or
    seeking employment with the U.S. government, among many other
    purposes. Levin's provision, which was included as an amendment to
    the Commerce, Justice, and Science (CJS) Fiscal Year 2008
    Appropriations Bill, would require the FBI to report to Congress
    every year regarding progress made in improving the FBI's system of
    processing background checks and automating investigative files.

    "The background check program's enormous backlog poses an
    unacceptable burden on people whose lives are on hold, and it also
    leads to a national security risk," Levin said. "Approximately
    31,000 cases have been pending for at least 33 months. If these
    individuals are a security threat, we must know that sooner rather
    than later."

    According to the U.S. Citizenship and Immigration Services (USCIS)
    Ombudsman's 2007 Annual Report, there were 329,160 name check cases
    pending in May 2007, which is and increase of 93,358 over the
    previous year. Many immigrants who are applying for adjustment of
    status to legal permanent resident, naturalization, asylum, or a
    waiver end up waiting for months or years for the completion of the
    name check process.

    In 2003, Robert J. Garrity, Jr., then Acting Assistant Director of
    the Records Management Division of the FBI stated before the House
    Committee on Government Reform that, "[t]he name check delays have
    significant consequences to FBI customers and stakeholders. The
    delays impede hiring or clearing skilled workers; completing
    government contracts; student enrollment, and�clearing requested
    visas for business visits to the United States. More importantly
    than all of the foregoing, these processing delays can also diminish
    counterterrorism effectiveness."
