This is what my attorney told me:
4 Year Bachelors in India + 5 years of Exp (excluding sponsoring emp)
3 Year Bachelors in India + 2 Yrs(Msc) /3 Years(MCA) + 5 years of Exp (excluding sponsoring emp)
4 Year Bachelors in India + US Masters + 2 years of Exp (excluding sponsoring emp)
All these qualify for EB2. Just make sure you Job Description requires eb2.
Also, consult with a leading attorney and show you employer, that this is doable.

Got a call this morning (at 8 AM) from an IO at local office telling me that my case was approved.
After an hour, around 9 AM, I got another call from USCIS. I was pleasantly suprised with how polite the lady was. She told me that she was following up on the inquiry I had sent. She repeated what I already knew, that my case was approved on 10/26. I am assuming this was in response to the letter I had sent to USCIS secretary Napolatino. She congratulated me a couple times and I thanked her for calling me.
So folks who are waiting, please try everything you can. Draft one good letter, and send it to everyone you can and hope that at least one of those authorities will look at your letter and do something about it.
I also want to thank SeekerOfPeace who shared his letter to Sec. Napolatino with me.

Hi SSA,
Please update us on your I-94 # after you receive your H1B Approval Notice.
I agree that whenever you apply for Transfer/Extension USCIS issues,
the H1B Approval (I-797 Notice) with I-94 # same as the I-94 # you have
submitted along with your H1B Petition.
I haven't received the physical H1B approval notice from my attorney yet so I don't know what's the I-94 # on that one although I doubt it will be the same. AFAIK each I-94 number is unique and different. Anyway, I don't think I-94 number itself matters any, just the fact that you have valid, not expired I-94 is sufficient.
I did not fill the forms for the transfer myself (the attorney did) so I don't know for a fact what he entered in "last manner of entry" but I'm 99.99% sure they must have said "Paroled" as they asked for my I-94 that had "paroled" stamp on it to attach with the petition.
Finally, I did not get any RFE.

(1) We should all go back to our home land, because he has some opinions and positions on what is considered turning back to home land. As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.

whats up with USCIS issing RFE's and stuff for people with PD's so far away..Iam not sure what the RFE is but it makes me wonder what USCIS is doing with files with a PD of 04 that too eb3..:rolleyes:

I was seeing lot of posts in this forum about reverse brain drain, so I wanted to comeup with a question which would answer my question without doubt.
I wanted to see if all those who are in the GC queue and think that they are a very important for America and insist on that in their signature by saying "Help us stop reverse brain drain" are really meaning what they say.
I beleive if we are so much in demand we can get a job in another country and have similar quality of life or better. So only poeple who are confident of the reverse brain drain and America should stop it will not hesitate to vote "Yes" if they are so frustated with the GC wait times.
Once again thanks to everyone who so far particiapted in this poll and posted comments.

1) Use your credit history to purchase additional home in Florida. House purchase in 150000 will be 250000 in year. The market was like that a year back. It takes 8 months to get a house. There is a big line.
2) Open your own e-business. File E visa. 1/4 million should be easy money if you have stayed here for 10 years.
3) House listing in only done by realtor. Give option to customer. For fun open a site for people to list their house for sale. Give them free service then charge. Live American way.
4) Make school in Village. I have made one. I enjoy supporting the school. Grow India.
5) Don't worry about GC. Do something. Registering a site takes some $35 or 40. Built you site. Use American brain.
Am I doing it? Yes.. Did I make money? Yes.

Most economists agree with this view only people still propogating the myth of house ownership as an investment are Realtors and "Flippers" looking to unload their houses on ignorant suckers. People made money, yes, but that was upto mid that is when housing market peaked. It has been on sequential monthly decline since than. Buying house as an investment in current economic conditions is bad advise. Save money and wait till late 2007 or early 2008.
