I received a call from my lawyer last week saying he got a call from USCIS asking the lawyer whether my wife got the TB Skin test done or not, as she did not get it originally as we were expecting our child at the moment.
I sent the lawyer the scanned copy of the TB skin test results and posted him the sealed envelope separately yesterday, which he was planning on Faxing over to USCIS. Today I saw a soft LUD on my wife's I-485.
Don't know what this means? Its hard to belive that my Lawyer is so proactive to send the fax right away. And I can't believe that someone at USCIS actually updated my wifes case after lawyers response...
So don't know whats going on there... Friends whats meant by pre-adjudication?

If you didnt have money in ur pocket.. why the heck did you go for PHd.. now stop complaining about people who got a job and started working.. why dont you tell the truth to everyone that you didnt get a job after you completed MS and ultimately to keep yourself in US you opted for Phd.

EB3-I is the worst affected category and nobody even wants to talk about it.
I have been separated from my wife for 2 years and now I am going back and work in India.

My I-140 got approved even though my company also did not file 2006 Tax return. My company is a small(less than 30 employee) loss making company. Our company secretary just gave a letter that company has not filed tax return for 2006 and has asked for extension, attached request for extension. If you are meeting any one of the three criteria of the yates memo, there are very high chances of I-140 getting appoved. Search for yates memo and you will get more details. Is your current wages more than prevailing wages? If yes, then you will be fine. Your lawyer has do a very good analysis of companies ability to pay prevailing wages. So work with your lawyer and you will be fine.

I think there is another issue here. lets say you file for your 485 and you get married later in teh year..by that if PD retregresses again, your spouse wont be able to file for 485, since she gets your PD. so you might get approved sometime next year and you will loose your h1b status, then it gets to be a problem for the spouse since she is still waiting for PD to retrogress..so please talk to a lawyer and get all the facts...

You definitely need to defend yourself. If you do not, the default judgment may be entered against you (you'll be automatically guilty and responsible for the payment). Consult with an attorney first. You usually have 30 days to respond to the complaint. Did you get summons? If there are criminal charges against you, you are entitled to free government attorney. No need to ruin your life because of this.

For all of you who have send me a pvt. message asking me how to reach IO @ TSC, here are the steps:
1) Call Customer Service @ 1 800 375 5283
2) Continue in english, hit 1
3) To check the status, hit 2
4) Know your receipt number, hit 1
5) Enter Receipt number, and then for SRC, hit 1
6) Confirm Receipt Number, hit 1
7) You will now hear the status of your case. At this point, hit 3 to "Report a problem".
Here is the trick - now you will hear 4 options. I believe # 3 is "If your case is outside the processing time..." and # 4 is for "If you have filed several cases and have received a decision on....". You want to hit # 4 and you will be connected to an IO at TSC.
Just a word of caution: You will be talking to an Immigration Officer @ TSC so please be very polite. Some officers will tell you that they cannot give you any information, or you should be calling Customer Service number, simply say 'Thank You' and hang up. It might take days/weeks before you reach an IO who would be willing to help.
Again, the sequence is:
Call the customer service number.
Press 1, 2, 1, Enter Receipt Number, Hit 1 for SRC, Hit 1 to confirm RN, 3 to report a problem, 4 to connect to an officer @ TSC.
Also, you do not have to wait to hear the complete message. You can be connected to an IO in less than 30 seconds (trust me, you will get good at it). I had the print out of steps sitting in my car and I would go to my car every 2 hours and call TSC. A lot of people, including me have lost faith in IV. They are not going to pay. We don't know what IV is working on
I believe the core group has made efforts to let us know what they are working on. Obviously, we shouldn't expect them to give us a daily update. That would be quite stupid.

If you think that with 8000 members, and 300 contributing members, you can have the congress/senate pass pro-EB laws, you are grossly mistaken.
IV needs to figure out other ways to generate cash if it thinks that would help. One way would be advertising on the site. I think IV has built this website well and it is an asset it needs to use NOW. I believe IV can charge up to $10,000 a day for advertising on the website. That would be $300,000/month or $3.6 million a year. Even $3000/day would result in over $1 million. That should not be very difficult to do.

For a group that can't generate more than 4k-5k per month (200 contributions times 20) for something that it desperately needs, it would be an absolute travesty of common-sense for a business, to invest 300K per month in advertising to such a group.

Membership+funding+lobbying+patience = Chance of success
Sitting on our butts = Guaranteed failure
BTW, I would also like to point out the antiwar website again.
They are doing a funding drive.
On day 1 of their funding drive, 117 people gave a total of 5312 dollars.
Their goal is 70K for this quarter. And they hope to raise that money in one week. After this week, they will again ask for funding in the next quarter.
Obviously they have a HUGE membership compared to IV. But that just underscores the need for increasing membership.

I think SBI is best in convesion rate and also the time it takes to transfer the money.
ICICI gave nearly $1 less than prevailing rate they had on their website.
Even if you send a check, you get better rate if you deposit into an SBI account in India.
