Absolutely not. AC21 only removs the per-country limit in any calendar quarter in which overall applicant demand is less than the total of available numbers. In the present calendar year, the overall demand is defenitely more than the total of available number and AC21 priviledges would not apply.

Picture will become more clear in MAY when Pres. OBAMA will announce his plan for CIR 2009. If he does then chances of this bill going anywhere is very minimal. Also don't forget that this is just in senate. Same version needs to be pass in House. Amendment to Stimulas package regarding Financial Company cannot hire h1b was relatively easy. It doesnot need bill go through all sub committee and other lengthy process.
I think we should focus only on our main agenda. Green Card. We can closly watch this bill. Even if it advance to subcommitte in Senate ( Hearing and all ) then we can start move on it otherwise we will waste so much of our manpower and energy.

Regarding conributions, I know it is probably going to meet with some resistance from other members, but we can organize a membership drive week. Any current member signing up most members during that week can be rewarded in some way. The reward need not me monetary, because people are not here for money. So, the reward can be some sort of memento.
As far as contributions are concerned, there are many ways to raise money in this country like Raffles, Fund raising by selling some products. (See how Boys and Girls Scouts sells cookies.) and so on.
None of these is impossible. Remember, there is no such thing called IMPOSSIBLE, because the word itself says, I'MPOSSIBLE.

A question -- has IV considered challenging the country quota in court? Because the Constitution forbids discrimination based on country of origin..

It is important to know that despite of severe visa retrogression and random visa cutoff date movements, USICIS or DOS hasn�t released any official information on how many Adjustment of Status applications are pending at USCIS under various categories which leaves thousands of AOS(Adjustment of Status) applicants in complete darkness and dependent on guessing games by various Law firms.
A green card application requires enormous amount of efforts and money from the beneficiary and his/her employer. People who are waiting for 7-8 years now would have had already spent average $15,000-$20,000, in maintaining their statuses and keep the Green Card process going on. Being stuck in a green card process keeps us bonded with 1 employer, job type etc.
We need to know if there is any light at the end of the tunnel. We need to know for how long we have to live our life in limbo. If there is hope than we need to be patient and plan to live like that for another 1-2 years. But if there�s no light at the end of the tunnel than we need to move on with our careers and other family commitments. Only your office and USCIS can help us by releasing statistics on the number and categories of applications pending with USCIS people waiting in this category can plan their lives accordingly.
It will be a great help if DOS or USCIS could tell us about the number of AOS application pending at USCIS along with their Categories(EB-3, EB-2, EB-1) and chargeable country.
We have been waiting for a decade and continue to wait would it be reasonable to request you for some guidance with regards to the Visa allotment. I request your office to provide some statistics on home many Adjustment of Status applications are pending at USCIS.

You are right..it takes time and effort, and money too. We are ready to donate, if we are allowed to file EAD after 140 clearance immeditely, ,irrespective of EB-2 or EB-3. However, do not reply saying that you need to donate first as this is not how we think. There are a whole bunch of friends who are of the same opinion.

PD is Apr 06 - I-140 approved - Currently Unmarried � WILL TAKE ATLEAST ONE YEAR BEFORE I GET MARRIED - My Spouse will be residing in India at the time of marriage - Spouse would not have any valid U.S visa (H1 or L1).
I have read this thread and others, and I think I understand a little on how the process works. I am looking for your gut-feeling answer if I should apply for 485 or wait till I get married. Let�s assume that my marriage will take place only after one year from now.
I know it�s a very very tricky situation, I am very confused. Obviously, my preference is to wait for a longer time to get my GC, than separated from spouse for years.

However, I will dissect the above post line by line to pinpoint exactly why some people completely deserve the treatment that they get. One of the approaches can be for state chapters to be involved and solicit donations from local members. I liked the idea for donations from immigrants who have already obtained green cards and online ADS from google as long as we do not overdo it. I am leaning more towards funding drives. For reasons that people in the process understand better than I do, I agree that the amounts cannot be disclosed. Hence it would be nice to have offline discussions or discussions on PMs on targets between state chapter members.
I for one am not for monthly payments or memberships. That just makes for exclusive organization and we want to be more inclusive.
I also had another important question we need to ask ourselves. Do we want to solicit funding or donations or participation? They are two very different things. Participation is not limited to monetary involvement but can include time and ability (designing banners, websites, writing letters et al.) donation.

As someone else mentioned earlier on this thread, your best bet is to counter-sue the party for >$3.25 M. Hire an attorney on contingency, i.e: you'll agree to a minimal base professional fees, say 5-10k and the rest of the cost of running this litigation will be incurred by your attorney. As someone else mentioned earlier on this thread, your best bet is to counter-sue the party for >$3.25 M. Hire an attorney on contingency, i.e: you'll agree to a minimal base professional fees, say 5-10k and the rest of the cost of running this litigation will be incurred by your attorney.
